Article 3. Definitions

The terms used in these general conditions of sale or on the Herbandbloomstore.com site must be understood as follows:

§3.01 Herbandbloomstore.com: the website of Ambitious Ventures, www.herbandbloomstore.com and all subdomains , on which the Products are presented and sold to Customers.

§3.02 Customer: any natural or legal person, legally capable, who places an order for Product(s) through the website Herbandbloomstore.com.

§3.03 Order: request for conclusion of a sales contract by the Client between Ambitious Ventures and the Client of the Herbandbloomstore.com internet store concerning the Products presented by Herbandbloomstore.com.

§3.04 Product Sheet: designates the information (texts, photos, classification system by section, etc.) linked to a Product offered for sale on the Herbandbloomstore.com website.

§3.05 Products: all goods offered for sale by Ambitious Ventures through the vector of Herbandbloomstore.com.

§3.06 Transaction: all operations, secure processing, authorizations and agreements inherent to the payment of Products ordered by credit card or any other means of virtual transaction offered on the Herbandbloomstore.com website .

Article 4. Acceptance of the general conditions of sale

§4.01 The Customer acknowledges having read these general conditions of sale and declares, by placing the order, to expressly accept them without reservation. Validation of the order constitutes acceptance of the general conditions of sale.

Article 5. Purpose

§5.01 Ambitious Ventures offers for sale online the Products usually sold in its herbalist store. These include plants, herbs, spices, dietary supplements, food, cosmetics and accessories.

§6.04 The offer is still valid while stocks last and may be adapted or withdrawn by Herbandbloomstore.com at any time. Herbandbloomstore.com cannot be held responsible for the unavailability of a Product. If an offer has a limited duration or is made subject to conditions, this will be explicitly mentioned in the offer.

Article 7. Order

§7.01 All information provided by the Customer, when encoding the data inherent to his order, is binding on him. Herbandbloomstore.com cannot under any circumstances be held responsible for errors made by the Customer in the wording of the contact details of the recipient of the order (delivery address, billing address in particular) and for delivery delays or the impossibility of delivering the items. Article 8. Delivery

§8.01 After confirmation of the order and acceptance of payment from the organization responsible for the transaction (Stripe.com), Herbandbloomstore.com undertakes to have the Products ordered shipped to the Customer as quickly as possible and according to its possibilities. to the delivery address mentioned. §8.03 When a delivery is delayed, or if an order cannot or only partially be executed, the Customer is informed no later than one month after placing the order. If applicable, the Customer has the right to modify or cancel his order and request a refund of the product(s).

§8.04 By placing an order, the Customer undertakes to pay upon receipt of the goods, all taxes, duties, imposts and other present and future charges due upon delivery of the Products ordered. Ambitious Ventures cannot be held responsible in any way in this regard.

§8.05 Delivery is carried out by recognized transport companies such as BPost or DPD. Herbandbloomstore.com nevertheless reserves the right to use another carrier when it considers it preferable. Delivery rates and times are available on the website www.herbandbloomstore.com.

§8.06 Upon receipt of the Products ordered, the Customer or recipient must check the good condition of the Product delivered and read its conditions of use appearing in the instructions for use provided to him. In the event that one or more of the Products ordered are missing or damaged, the Customer or recipient must immediately make the necessary reservations to the carrier at the time of delivery.

§8.07 If a package is not received despite the carrier's various passes (maximum three passes), it is returned to Herbandbloomstore.com and the recipient is notified by e-mail. Additional delivery may be requested by the buyer and he will bear the costs (even if the first shipment was made free of charge).

§8.08 The risk of loss or damage to the Products passes to the Customer from the moment the latter (or a third party designated by them, not being the carrier) has received the goods in physical possession. The risk nevertheless already passes to the Customer, if the carrier has received an assignment from the Customer to transport the goods and this choice was not offered by Herbandbloomstore.com.

§8.09 When the Customer requests total or partial reimbursement following an excessively long delivery time, the company will reimburse the amount paid by the Customer as soon as possible, and this at the latest within 14 days after dissolution of the sales contract.

Article 9. Complaints

§9.01 Complaints relating to the execution of the contract, such as any visible and/or qualitative defect in an item or other failure to deliver, must be filed directly with Herbandbloomstore.com, described clearly and exhaustively, after observing the breaches by the Client, at the risk of infringing the Client's rights. These complaints must be communicated to us via webshop@herbandbloomstore.com.

§9.02 Complaints filed with Herbandbloomstore.com will be responded to within 14 days from the date of receipt. If a complaint requires a foreseeable longer processing time, Herbandbloomstore.com will send a response within 14 days, acknowledging receipt and giving an indication of when the Customer can expect a more detailed response.

Article 10. Withdrawal

§10.01 In accordance with the legislation in force for distance selling (law of December 21, 2013), the Customer benefits from the right to renounce his purchase without penalties and without indication of reason. To submit this withdrawal request, the Customer must submit the withdrawal form (an example of this form is attached to these general conditions), and this within 14 calendar days after receipt of the goods, by e-mail to webshop@herbandbloomstore. com.

§10.02 The Client has a period of 14 calendar days from the date of sending the withdrawal form, to return them to Ambitious Ventures for exchange or reimbursement. To obtain a refund or exchange, the Customer must return the Product(s) to the customer at his own expense (in accordance with Art. VI.51 § 1.) and under his responsibility. The Product(s) must be returned in their original packaging, intact, accompanied by all possible accessories (such as and among other instructions for use and documentation) and a copy of the purchase invoice. The Customer must prove that the shipment was made on time, for example by proof of shipment.

§10.03 If the value of the returned Product is in one way or another reduced, Herbandbloomstore.com reserves the right to make the Customer responsible and to demand compensation for any reduction in the value of the goods which results from the use of the Products by the Customer or damage during the return to Herbandbloomstore.com.

§10.04 If the Products are returned to Herbandbloomstore.com under the aforementioned conditions and deadlines, Herbandbloomstore.com undertakes to reimburse the sums paid by the Customer, free of charge. Shipping costs related to the return of Products are not reimbursed by Herbandbloomstore.com (unless the error lies with the latter). Reimbursement occurs within a maximum period of 14 days from receipt of the goods by Herbandbloomstore.com. Additional costs due to the Customer's choice for a delivery method other than the standard delivery method offered by Herbandbloomstore.com will not be reimbursed.

§10.05 The Customer cannot exercise the right of withdrawal for:

1° the supply of goods likely to deteriorate or expire quickly;

2° the supply of sealed goods which cannot be returned for reasons of health protection or hygiene and which have been unsealed by the Customer after delivery;

3° the supply of goods manufactured according to the Customer's specifications.

Article 11. Price

§11.01 The price indicated on the Product Sheets is expressed in euros and does not include transport costs. The accompanying photos are intended to be decorative and may contain items that are not included in the price.

§11.02 The price indicated in the order confirmation is the final price expressed all taxes included and including VAT. This price includes the price of the Products, the costs of handling, packaging and conservation of the Products, and transport costs.

§11.03 Herbandbloomstore.com reserves the right to modify the price of the Products at any time but the Products are invoiced on the basis of the prices in effect at the time the orders are registered.

§11.04 Despite the fact that the online catalog and the e-commerce website have been assembled with the greatest care, it is nevertheless possible that the information given is incomplete, contains material errors, or is not up to date . §13.03 The liability of Herbandbloomstore.com / Ambitious Ventures will, in any case, be limited to the amount of the order and cannot be held responsible for simple errors or omissions which could have remained despite all the precautions taken in the presentation some products. §14.02 To be able to claim the guarantee, the Customer must be able to show proof of purchase. It is advisable to keep the original packaging of the Products.

§14.03 With regard to Products purchased online and delivered to the Customer, the Customer must return the Product at his own expense.

§14.04 In no case will Herbandbloomstore.com or Ambitious Ventures be held responsible for non-compliance with the regulatory and legislative provisions in force in the receiving country. The possible liability of Ambitious Ventures is exclusively limited to the value of the Product in question, determined on the date of its sale.

§14.05 The warranty is never applicable if the defect is due to an accident, negligence, a fall, use of the Product contrary to the purpose for which it was designed, non-compliance with the instructions use and documentation, adjustments or changes to the Product, heavy use, improper maintenance, or any other abnormal or incorrect use of the product. The company is never responsible for the final suitability of the Products for each individual application by the Customer, nor for any advice on the use or application of the Products.

Article 15. Personal data

§15.01 The collection of personal information carried out for the purposes of distance selling is mandatory, this information being essential for the processing and delivery of orders. Failure to provide information will result in non-validation of the order.

§15.02 Herbandbloomstore.com complies with the Belgian law of December 8, 1992 in relation to the processing of personal data, revised by the law of December 11, 1998, which takes into account the European directives of October 24, 1995.

Article 16. Dispute and applicable law

Failing this, only the courts of Brussels have jurisdiction, regardless of the place of delivery of the Products or the Customer's domicile.

§16.02 Contracts and all legal relationships between the Client and Herbandbloomstore.com/Ambitious Ventures are subject to Belgian law.

§16.03 Customer agrees that electronic communication and backups may be used as proof.

Article 17. Change of the General Conditions of Sale

§17.01 Herbandbloomstore.com may change these general conditions of sale at any time. To do this, they must be published on the website. For a period of one month, the Client may use the most favorable provision for the Client.

Article 18. Affecting validity – non-waiver
